It requires a doctor-patient relationship, a breach of the duty of care, causation, and resultant harm.

Medical Battery, on the other hand, is an intentional tort where a healthcare provider performs a procedure without the patient's informed consent or goes beyond the scope of the patient's consent. The key factor is the violation of a patient's autonomy and bodily integrity, and harm to the patient is not a necessary element to establish a case of medical battery.
